Hazardous, Toxic and Radioactive Waste projects are implemented following the Comprehensive Environmental Response, Compensation, and Liability Act. The Buffalo District focuses on sites that are covered under two federal programs - the Formerly Utilized Sites Remedial Action Program (FUSRAP) and the Defense Environmental Restoration Program for Formerly Used Defense Sites (DERP-FUDS).

The Formerly Utilized Sites Remedial Action Program was initiated in 1974 to identify, investigate, and clean up or control sites throughout the United States that were part of the Nation’s early atomic weapons and energy programs.

The Defense Environmental Restoration Program was established in 1986 to address contamination caused by Department of Defense activities. Sites no longer owned by the Department of Defense as of October 17, 1986, are addressed under the Defense Environmental Restoration Program for Formerly Utilized Defense Sites.
